Why I granted #EndSars protester bail —Ondo judge

The Ondo State High Court, Sitting inside Olokuta Correctional Centre (Akure Prisons), in Akure, the state capital today granted bail to kemisola Ogunniyi, the detained #EndSars Protester who delivered a baby in the Prison, to the sum of N10 million with a surety.

The bail is coming a day to the naming ceremony of the baby.

It would be recalled that Kemisola Ogunniyi was arrested along with 3 (three) other suspects, by the Ondo State Command of the Nigeria Police Force, during the curfew imposed in Ondo State in the wake of the #EndSARS protest in October 2020 and was accused of setting ablaze the APC Secretariat during the protest.

Kemisola was charged for arson, conspiracy, riotous assembly, stealing and malicious damage.

Granting the bail application, Justice Omolara Adejumo cited Section 146, 150, 156 of the Ondo State criminal justice law, stressing that she was released based on humanitarian ground, and for the purpose of the naming ceremony, adding that she has a right to be granted bail.


She added that the defendant should be bailed with the sum of N10 million with a surety.


Justice Omolara however faulted the trending of the issue on the social media space.

Earlier, the Prosecuting Counsel led by Omotola Cicilia, Ologun Prayed the court to grant the bail of the defendant.


She added that “It was on the 17th of June 2020 that the office of Attorney General was served a bail application by a new Counsel (Tope Temokun Esq) engaged by Kemisola Ogunniyi”.

Meanwhile, Counsel to the defendant, Tope Temokun, expressed satisfaction with the release as well as the bail condition.

He noted that the 3 (three) other suspects, arrest by the Ondo State Command of the Nigeria Police Force, during the curfew imposed in Ondo State in the wake of the #EndSARS protest in October 2020 and was accused of setting ablaze the APC Secretariat during the protest.

According to him,”there is nothing negative about this issue, the whole world knew that a boy was born and am very sure that tomorrow, the whole world will also know the name of that boy. The boy has been announced to the world and am very confident that the boy is going to be great.

According to Temokun, “We were fighting that Kemisola should not deliver in prison but she eventually delivered in prison, the noise was everywhere, so if we say we don’t want the naming ceremony in the prison custody, it is still part of the agitation to get her released and thank God, she has been released.

He added that, “it’s not about negativity, when we talk about prominent people in the world, most of them have been to the prison. Is it Mandela or Buhari? Obasanjo or Yaradua? He questioned.”

According to Temokun, “I am confidently telling you that the quest to release Kemisola from prison is not about any negativity because I know that the boy is already born great and people are eager to know the baby’s name and they are ready to attach importance to the name. Am sure that he’s coming up great.”
