Akoko MHA race: Gbogi should stop parading himself as APC candidate —Lawyer tells Court

…Lawyer ASKS GBOGI TO STOP PARADING HIMSELF AS APC FLAG BEARER.

Barrister Odunayo Moses Esq., a lead counsel of about 6 lawyers; Barrister Deji Stephen Akinmuwagun Esq, Barrister Adegbenro Joseph Esq, Barrister Adeyinka Ojo Esq, Barrister Ebenezer Akintunde Esq, and Barrister James Oluwaseyi Esq to HON AJOBIEWE DAVID asks Hon Gbogi Emanuel in a summon to stop parading himself as an MHA flag bearer of APC in Akoko southwest LG constituency 1; until the Federal high court gives it final verdict based on some vital exhibits presented against him regarding the 3 counts allegations levelled against Hon Gbogi.

The leading counsel Barrister Odunayo emphasises according to Section 137, 182, 66 and 107 of the Nigerian Constitution and same as Article 12. 2 B of APC constitution, that GBOGI is not qualify and eligible to contest for an elected office position presently.

Barrister Moses stresses, in Article 31 of Nominations of candidate, Gbogi is not also eligible to be voted for as an MHA candidate according to the APC constitution re; the second count levelled against him.

Further in Article 31.4 of conditions for waiver of the APC constitution, Hon Gbogi parading himself as a flag bearer is not eligible.

Barrister Odunayo details according to the electoral act 2022 of part IV procedure at election says, where the court find guilty of the offences to the constitutional requirement of eligibility, the court shall issue an order disqualifying the candidate and the sponsoring political party declare the second highest number of valid votes and who satisfies the constitutional requirements as the winner of the election who is Hon David AJOBIEWE.

Mr. Femi Ayoko, the DG to AJOBIEWE campaign Organization addressed the press at the high court, that AJOBIEWE has been with the APC party since 2015.

He has been investing in people and sponsoring the party as well. Ayoko stated further that, in re-election bid of Arakunrin Akeredolu, the executive Governor of ondo state; AJOBIEWE involvement can never be overlooked as well and Oke Oka where his principal comes from cannot be emptied politically.

Ayoko implores the party to do needful before the case go far, because according to the electoral act 2022, a political party which present to the commission the name of a candidate who does not meet the qualifications stipulated in this section an offence and is liable on conviction to a fine of N10,000,000. And he doesn’t think APC party in the state or Enginer Adetimehim can afford to joke with the huge sum of amount.
